Conditions of Carriage
As a replica of a 19th century topsail schooner, Enterprize closely emulates the original vessel whilst strictly operating to 21st century maritime law and practices. While we make every effort to ensure passenger comfort, as the Enterprize is a traditional sailing experience you may expect:
- A safety briefing prior to departure
- A moving deck under your feet
- Challenges to your personal comfort
- Physically demanding situations
- The full range of weather conditions
- Marine toilet facilities
Definitions:Â
- The Enterprize refers to the marine vessel registered: MB1835
- The Trust refers to the Enterprize Ship Trust, a registered not-for-profit organisation entrusted with the ownership and operation of the Enterprize, and any agent that is authorised to represent them.
- The Directors are the trustees charged with the management and operation of the Trust.
- The Master is the qualified individual appointed by the Trust who is responsible for the operation of the Enterprize and the management of the crew.
- The Crew are any persons who are both registered with the Trust and have been assigned operational duties by the Master.
- A Voyage is any experience that involves a planned overnight stay on the Enterprize.
- An Excursion is any experience that is planned to occur exclusively on a single day.
- A Booking is any agreement made between you and the Trust, regarding a Voyage or Excursion.
- A Charter is any Booking made for the exclusive use of the Vessel.
- A Passenger is any person on the Enterprize who is not an agent of the Trust, a member of the Crew, or the Master.
- A Customer is any person who intends to, or has made a Booking with the Trust
Voyage
Bookings:
- Bookings are transferable providing agreement by the Trust, and that all requested information is made available to the Trust.
- It is a requirement for Voyages that all passengers disclose known current medical conditions and dietary requirements. This information will be held in confidence by the Trust.
- The Trust accepts no responsibility for either assessing or monitoring whether you are medically or physically fit to undertake a voyage on the Enterprize.Â
- The Trust reserves the right to require medical certificates that declare passengers are physically capable of undertaking a voyage. The Trust can provide guidelines about the potential conditions experienced aboard.Â
- It is the responsibility of passengers to acquire personal medical coverage for the voyage. Although the Enterprize is operated to best maritime practice and law, personal injuries can happen.
Check In:
- It is the passengers responsibility to present themselves at the time and location indicated in the booking.
- The Master reserves the right to reject embarkation or require the disembarkation of any passenger, at any time, and the Master shall follow any course of action they deem necessary.
- If the departure time or location changes, the Trust shall endeavour to make contact with all passengers in a timely manner.
Conduct:
- Passengers are required to follow any reasonable directions given by the Master and the crew.
- Any decision made by the Master in regard to the safety of the Enterprize, passengers, and crew is final including enforced disembarkation. Any expenses incurred to the Trust by such action will be payable to the Trust by the passenger on demand.
- To the extent permitted by law the Trust, Master, and crew shall not be liable for any claims, losses, damages, injuries, costs, and expenses suffered, sustained, or incurred in any way connected with the voyage.Â
Property:
- The Trust takes no responsibility for the loss or damage of personal effects.
- If so desired, it is the passengers responsibility to obtain insurance against loss or damage of their personal effects.
Excursions
Bookings:

Cancellations and Refunds
Cancellation by Trust:
- Where a cancellation occurs due to circumstances preventing the Booking from proceeding, an alternative date will be arranged. If this is not practicable, a full refund will be provided.
- Enterprize reserves the right to cancel or vary without notice the voyage, departure and arrival times, routes, vessels and or places and accepts no responsibility for any loss or inconvenience caused.
- If a Booking is stopped during its operation for any reason other than a passenger requesting cancellation, a pro rata refund will be paid for that portion of the event not completed. This refund will not cover the passengers’ repatriation costs.
Cancellation by Customer:
- Written notices must be sent by email to sailing@enterprize.org.au and include the
Booking reference number. - If so desired, the Trust will make reasonable effort to reschedule a Booking.
- The customer’s refund will be paid into the customer’s nominated account via EFT.
- The administration fee is $5.00 inc GST
- Voyage Bookings and Charters are subject to a 20% deposit
- In the event that a Booking is successfully rescheduled, refunds will not be given.
Excursion Bookings
- Written notice in greater than 72 hours, the Trust will issue a full refund, less administration fee.
- Written notice in less than 72 hours, the Trust Retains 100% of fare.
Voyage Bookings and Charters
- Written notice in greater than 21 days, the Trust retains the deposit.
- Written notice in greater than 21 days, the Trust retains 100% of the fare.
No Refund if
- In the course of the Voyage the Passenger must be repatriated for a medical or physical condition.
- The Passenger is repatriated by the Master for safety reasons, as per Carriage Conditions.
- During a Voyage in progress the Passenger requests termination of that Voyage.
- Non-appearance or no written notice.
Note: Enterprize Gift and Promotional Vouchers are not transferrable to dates or events outside their individual terms and conditions, nor are they refundable.
Note: Bookings made through third party providers are also subject to the provider’s terms and conditions.
